1. Overview & Our Commitment
MzansiFans (operated by MzansiFans (Pty) Ltd, Republic of South Africa) respects the intellectual property rights of creators and third parties. We comply with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512 and relevant South African copyright legislation under the Copyright Act 98 of 1978 (as amended).
If you believe that content hosted on our platform infringes your copyright, please follow the procedure below to submit a formal takedown notice. We will respond promptly and, where appropriate, remove or disable access to the allegedly infringing material.
Note: MzansiFans is a platform that hosts creator-uploaded content. We do not pre-screen all uploads but act expeditiously upon receiving valid DMCA notices.
2. Filing a DMCA Takedown Notice
To report copyright infringement, send a written notice to our Designated Copyright Agent (see Section 8). Your notice must be in writing (email is acceptable) and must include all elements listed in Section 3.
Upon receipt of a complete and valid notice we will:
- Acknowledge receipt within 2 business days.
- Remove or disable access to the allegedly infringing content expeditiously (typically within 24–72 hours of verification).
- Notify the uploader that their content has been removed and provide them with a copy of your notice (with your personal contact details redacted where legally permissible).
- Inform the uploader of their right to file a counter-notification.
Warning — Misrepresentation: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees. Please only submit notices for content you genuinely believe infringes your copyright.
3. Required Notice Elements
A valid DMCA takedown notice must include all of the following:
- Your full legal name and contact information — name, mailing address, telephone number, and email address.
- Identification of the copyrighted work — a description of the original work you claim has been infringed. If multiple works are covered, a representative list is acceptable.
- Identification of the infringing material — the URL(s) on MzansiFans where the allegedly infringing content is located, with enough detail for us to locate it.
- A statement of good faith belief — "I have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law."
- A statement of accuracy and authority — "I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner or am authorised to act on behalf of the copyright owner."
- Your physical or electronic signature — typing your full name constitutes an electronic signature.
Notices that are missing any of the above elements may be rejected or returned for completion before action is taken.
4. Counter-Notification Procedure
If you believe your content was removed as a result of a mistake or misidentification, you may submit a counter-notification to our Designated Agent. A valid counter-notification must include:
- Your full legal name, address, telephone number, and email address.
- Identification of the removed material — the URL(s) at which the material appeared before removal.
- A statement under penalty of perjury that you have a good faith belief the material was removed as a result of a mistake or misidentification.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which MzansiFans may be found), and that you will accept service of process from the person who filed the original notice.
- Your physical or electronic signature.
Upon receipt of a valid counter-notification, we will:
- Forward a copy to the original complainant.
- Inform both parties that the removed content will be reinstated in 10–14 business days unless the complainant notifies us that they have filed a court action against you.
- Reinstate the content after the waiting period if no court action has been filed.
5. Repeat Infringer Policy
MzansiFans has a zero-tolerance policy for repeat infringers. In accordance with 17 U.S.C. § 512(i), we will terminate the accounts of users who are found to be repeat infringers of copyright in appropriate circumstances.
A user will be considered a repeat infringer if they have had two or more valid DMCA notices accepted against content they uploaded, or if they repeatedly upload content they do not own the rights to.
Terminated accounts will forfeit all credits and earnings held in their wallet, subject to applicable South African consumer protection law.
6. Non-Copyright Complaints
Non-Consensual Intimate Images (NCII)
We have a strict policy against non-consensual intimate imagery ("revenge porn"). To report NCII, email safety@mzansifans.co.za with the URL of the content and a brief description. We treat these reports with the highest urgency and will review within 24 hours.
Child Sexual Abuse Material (CSAM)
MzansiFans has a strict 18+ policy. Any content depicting minors in a sexual context is illegal and will be removed immediately, reported to the South African Police Service (SAPS) and the National Center for Missing & Exploited Children (NCMEC) CyberTipline as required by law. Report CSAM immediately to safety@mzansifans.co.za.
Other Content Violations
For content that violates our Terms of Service for reasons other than copyright (e.g., harassment, impersonation), use the in-app report function or email support@mzansifans.co.za.
7. 18 U.S.C. § 2257 Compliance
MzansiFans requires all creators to verify their age and identity before uploading any content. All performers depicted in sexually explicit content hosted on this platform have represented to MzansiFans that they are 18 years of age or older at the time of upload.
Records required by 18 U.S.C. § 2257 and 28 C.F.R. Part 75 are maintained by the individual content creators/producers. MzansiFans acts as a secondary producer as defined under 18 U.S.C. § 2257. Exemption records are available upon lawful request.
